Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Ice Fish Tiny Triumphs developed by GamesOcean ("we," "us," or "our") governing your use of the TinyTriumph mobile application ("App").

By downloading, installing, or using our App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our App.

Description of Service

TinyTriumph is a micro-habits and wellness application designed to help users build healthy habits through quick, manageable daily tasks. The App provides:

• Daily micro-tasks organized into morning, afternoon, and evening time slots
• Guided breathing exercises for stress relief
• Progress tracking and streak monitoring
• Achievement system for motivation
• Mood check-ins and personalized suggestions
• Customizable trackers and widgets

Eligibility

You must be at least 13 years of age to use our App. If you are under 18 years of age, you represent that you have your parent's or legal guardian's permission to use the App and that they have read and agreed to these Terms on your behalf.

By using the App, you represent and warrant that you meet all eligibility requirements.

User Account

The App may store your data locally on your device without requiring account registration. You are responsible for maintaining the security of your device and any data stored on it.

If the App offers optional account features in the future, you will be responsible for:

• Providing accurate and complete information
• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

Acceptable Use

Intellectual Property

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, graphics, and the design, selection, and arrangement thereof) are owned by Ice Fish Tiny Triumphs developed by GamesOcean and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use only. This license does not include:

• The right to modify, copy, or distribute the App
• The right to use the App for commercial purposes
• Any ownership rights in the App

Health Disclaimer

Important: The App is designed for general wellness and habit-building purposes only. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

• Always consult with a qualified healthcare provider before starting any exercise program
• Stop any exercise immediately if you experience pain, discomfort, or other symptoms
• The exercises provided are general suggestions and may not be suitable for everyone
• We do not guarantee any specific health outcomes from using the App

You use the App and perform any exercises entirely at your own risk. We are not responsible for any injuries or health issues that may result from using the App.

Third-Party Services

The App may contain links to third-party websites or services, including but not limited to:

• Google Play Store
• Analytics services
• Push notification services

We are not responsible for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be liable for any damage or loss caused by your use of any third-party services.

Modifications to the App

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.

Updates

We may release updates to the App from time to time. These updates may be required for you to continue using the App. You agree to install such updates as they become available. Failure to install updates may result in reduced functionality or inability to use the App.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• WARRANTIES OF NON-INFRINGEMENT
• WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
• WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE APP

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL Ice Fish Tiny Triumphs developed by GamesOcean BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE APP
• DAMAGES RESULTING FROM ANY CONTENT OR CONDUCT OF THIRD PARTIES

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid to use the App, if any.

Indemnification

You agree to defend, indemnify, and hold harmless Ice Fish Tiny Triumphs developed by GamesOcean and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the App
• Your violation of any third-party rights

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Ice Fish Tiny Triumphs developed by GamesOcean is established, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising from or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiations. If the dispute cannot be resolved through negotiations, it shall be submitted to binding arbitration in accordance with applicable arbitration rules.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ice Fish Tiny Triumphs developed by GamesOcean regarding your use of the App and supersede all prior agreements and understandings.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date.

Your continued use of the App after any changes constitutes your acceptance of the new Terms. We recommend reviewing these Terms periodically.
